WP No. 3497 of 2026 Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondent to pay interest at the rate of 6 percent per annum to petitioner for the belated payment of Pension Commutation from the date of retirement to the date of actual payment within a time frame as may be fixed by this Honble court. For Petitioner(s):

M/s.D.Ramya G.Prasannadevi For Respondent(s):

Mr.C.Gauthamaraj Common Order These Writ Petitions have been filed seeking a direction to the respondent to pay interest at the rate of 6 percent per annum for the belated payment of Gratuity, Provident fund, EL Surrender and Leave Salary and Pension Commutation respectively from the date of retirement to the date of actual payment to the petitioners, within a time limit as fixed by this Court.

2. It is the case of the petitioners that they joined the service of the respondent Corporation during the year 1992 to 1994 and had retired from

service on 30.04.2024, 30.06.2024 & 31.05.2024 respectively. However, the Gratuity, Provident fund, EL Surrender and Leave Salary and Pension Commutation respectively were paid belatedly. Therefore, the petitioners claimed 6% interest on the belated settlement of retirement benefits and they had also made a representation on 26.12.2025, 19.12.2025, 11.12.2025 & 12.11.2025 respectively to pay interest for the belated settlement of retirement benefits which has not evoked any response so far. Hence, the present Writ Petitions.

3. Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petitions are taken up for hearing at the admission stage itself.

4. In view of the limited request made by the petitioners with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to pay interest at the rate of 6% p.a. for the belated payment of retirement benefits as stated supra from the date of retirement till the date of actual disbursal of the retirement benefits of the petitioner, if there is no impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.

5. Accordingly, these Writ Petitions are disposed of. There shall be no order as to costs.
