1.M.Ananthi ...1st respondent/Petitioner 2.P.Vasuki ... 2nd respondent/1st Respondent Prayer: Civil Miscellaneous Appeals filed under Section 173 of the Motor Vehicles Act, 1988 against the award and decree dated 29.04.2015 made in M.C.O.P.No.188 of 2013 on the file of the Motor Accident Claims Tribunal Chief Judicial Magistrate Court, Perambalur.
Decree: This Civil Miscellaneous Appeal coming on for hearing on this day, upon perusing the grounds of Appeal, the award of the Tribunal below and the material papers in this case and upon hearing the arguments of Mr.D.Bhaskaran, Advocate for the Appellant and Mr.T.Gopinath, Advocate for the 1st Respondent and 2nd Respondent Not appearing in person or by Advocate and this court observes that the counsel for the Appellant hrerein / Insurance Company submit that he has already deposited the entire award amount awarded by the tribunal this court doth order and decree as follows:- (i) that the compensation award and Decree dated 29.04.2015 made in M.C.O.P.No.188 of 2013 on the file of the Motor Accidents Claims Tribunal Chief Judicial Magistrate, Perambalur be and hereby is confirmed and this Civil Miscellaneous Appeal is dismissed.
(ii) that the compensation shall carry interest at the rate 7.5% p.a awarded by the tribunal be and hereby is confirmed.
(iii) that the tribunal be and hereby is directed to transfer the amount lying to the credit of MCOP.No.188 of 2013 to the bank account of the Appellant / claimant through RTGS within a period of one week thereafter.
