J U D G M E N T
This second appeal filed against the judgment and decree dated 28.04.2000 in A.S.No. 9 of 2000 on the file of the Principal District Judge, Dharmapuri at Krishnagiri, confirming the judgment and decree dated 16.11.1999 in O.S.No.151 of 1997 on the file of the District Munsif cum Judicial Magistrate, Uthanagarai.
2. The learned counsel appearing for the appellant submitted that the third respondent died long back and seeks time to file petition to implead the legal heirs of the third respondent. On several occasions, the same representation made 1/2 https://hcservices.ecourts.gov.in/hcservices/
and even then, the appellant did not take any steps to implead the legal heirs of the third respondent.
3. Therefore, the second appeal is dismissed for default. No costs.
