(a) For an order directing the respondent company namely, M/s.

Protchem Industries (India) Limited, be wound up under the provisions of the Companies Act, 1956 (1 of 1956).

(b). For the appointment of the Official Liquidator, High Court, Madras to take charge of the assets of the respondent company. (c ). For an order directing the respondent company to pay the costs.

This Company Application praying that this Hon'ble Court be pleased to appoint the Official Liquidator, High Court, Madras, as the Provisional Liquidator to take charge of the affairs of the respondent company pending disposal of the above Company Petition. This Company Petition along with Company Application coming on this day before this Court for hearing in the presence of Mr. Pawn Jabak for Mr.Harishankar Mani advocate for the petitioner/applicant in Comp.Petn. No.101 of 2003 and Comp.A.No.361 of 2003 herein and upon reading the Judges summons and affidavit of S.Ramesh filed in herein, the court made the following order:

"Mr.Pawn Jabak, learned counsel appearing for the petitioner would submit that he has got instructions to withdraw this petition.

2. Recording the said statement of the counsel for the petitioner, this Company Petition is dismissed as withdrawn. No costs. Consequently, the connected application is also closed.
