PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the 2nd respondent to take necessary action against Pugazhenthi, Anbu, Siluvai, Sabari, Dhanapal and Yuvaraj and seized the vehicle from them and handover to Judicial Magistrate-V, Salem based on the F.I.R in Crime No.168 of 2016, dated 18.06.2016 registered by the 2nd respondent as per the instruction of the 2nd respondent.

O R D E R

This petition has been filed to direct the 2nd respondent Police to take necessary action against Pugazhenthi, Anbu, Siluvai, Sabari, Dhanapal and Yuvaraj and seize the vehicle from them and handover to Judicial Magistrate-V, Salem based on the F.I.R in Crime No.168 of 2016, dated 18.06.2016 registered by the 2nd respondent as per the instruction of the 2nd respondent. 2.The learned Additional Public Prosecutor on instructions submitted that on the complaint given by the petitioner a case in Crime No.168 of 2016 has been registered and the 2nd https://hcservices.ecourts.gov.in/hcservices/

respondent police have conducted an enquiry and closed the same as 'mistake of fact'. Therefore, the prayer sought for in this petition has become infructuous.

3.In view of the above submission, nothing survives in this petition. Accordingly, this Criminal Original Petition is dismissed as infructuous.
