Criminal Original Petition has been filed under Section 439 (1)(b) of Cr.P.C, to modify the order passed by the Learned Principal District and Sessions Judge Coimbatore in Crl.M.P.No.5576/2021 in Cr.No.577/21 on the file of the Respondent Police such that instead of the order for petitioner to produce two sureties likesum each to the value of Rs.10,000/- to the satisfaction of Judicial Magistrate No.4, Coimbatore and to report before respondent Police twice daily, the petitioner may execute a bond before Chief Judicial Magistrate, Egmore, Chennai and appear before the Respondent Police and when required for enquiry.

O R D E R

This Criminal Original Petition has been filed to modify the condition imposed by the Learned Principal District and Sessions Judge Coimbatore in Crl.M.P.No.5576/2021 in Cr.No.577/2.

2. The learned counsel for the petitioner submits that while granting bail to the petitioner, the lower Court below imposed certain conditions to the petitioner and one such condition is

that the petitioner is directed to sign before the respondent police daily twice ie., daily at 10.00 a.m. and 5.00 p.m. until further order. Now it is submitted by the learned Counsel appearing for the petitioner, that the petitioner has complied with the above conditions without fail and further submits that the petitioner aged about 67 years and she is a correspondent of KSG College and hence seeks for modification of the condition. 3.Learned Additional Public Prosecutor appearing for the respondent, on instructions, submits that the petitioner has been complying with the conditions without fail.

4. In view of the above submission, this Court is of the considered view that the prayer as sought for by the petitioner could be acceded to.

5. Accordingly, the condition insofar as appearance as imposed on the petitioners by an Order in Crl.MP.No.5576 of 2021 dated 03.01.2022 alone stands relaxed and the petitioner shall appear before the respondent police as and when required for interrogation. All other conditions remain unaltered.
