Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus, directing the Respondents to appoint the Petitioner as a regular Junior Assistant in the time scale of pay with effect from 21.07.2011 with all consequential benefits consequent upon passing the special competitive examination for the post of Junior Assistant conducted by the 1st Respondent without reference to the pendency of the Charge Memo issued by the 3rd Respondent vide Na.Ka.No.45431/2009 (Aa.3) dated 05.03.2010 within a stipulated period.

O R D E R

Petitioner has come up with the present Writ Petition seeking a direction to the Respondents to appoint him as a regular Junior Assistant in the time scale of pay with effect from 21.07.2011 with all consequential benefits consequent upon passing the special competitive examination for the post of Junior Assistant conducted by the 1st Respondent without reference to the pendency of the Charge Memo issued by the 3rd Respondent vide Na.Ka.No.45431/2009 (Aa.3) dated 05.03.2010.

It is represented by the learned Special Government Pleader appearing for the Respondents that departmental proceedings are pending against the Petitioner. He further submitted that there is no criminal case pending against the Petitioner, but he was cited only as a witness. He went on to state that the departmental proceedings are with regard to other issues also. 3.

Since enquiry is pending against the Petitioner, Respondents are directed to conduct enquiry on a day-today basis without adjourning the matter beyond three working days at any point of time and pass appropriate orders within a period of twelve (12) weeks from the date of receipt of a copy of this order.

This Writ Petition is disposed of with the above direction. No costs.
