This Civil Miscellaneous Petition has been filed seeking to modify the order passed in C.M.P.No.23744 of 2023 dated 27.11.2023, instead of , to pay the amount of Rs.3 lakhs and to allow this petition for discharging the petitioner from the proceedings initiated in E.P.No.20 of 2022 for motor claims on the file of Special District Court at Krishnagiri.

Mr.V.Nithyanandam, learned counsel for petitioner would submit that by relying the ratio laid down in the authority reported in 2018 (3) L.W. 261, in the case of Mrs. Balamanohari, rep. by power agent Rajalingam and another vs. M/s. Sri Venkateswara College of Engineering, rep. by its Chairman and others, he prayed to discharge him from the proceedings initiated in E.P.No.20 of 2022 before the Motor Claims, Special District Court, Krishnagiri and also discharge him from depositing the amount.

3. On seeing the facts, the petitioner has not made valid transfer of vehicle. Hence, he is directed to comply the order passed by this court in C.M.P.No.23744 of 2023 dated 27.11.2023. The time is extended for the period of six weeks for depositing the amount from the date of receipt of copy of this order.
