Criminal Original Petition filed under Section 482 Cr.P.C, to direct the learned Judicial Magistrate, Thittagudi, to expedite the trial in C.C.No.232 of 2015 on day to day basis within a stipulated time to secure the ends of justice. ORDER

This petition has been filed by the accused No.1/petitioner to direct the learned Judicial Magistrate, Thittagudi, to expedite the trial in C.C.No.232 of 2015 and dispose of the same at early.

2. The learned counsel for the petitioner has submitted that the respondent herein has filed a charge sheet against the petitioner herein and three others for the alleged offence punishable under Sections 294(b), 323, 324 and 506(ii) of IPC. Based on the same, the learned Judicial Magistrate, Thittagudi has taken the case on file in C.C.No.232 of 2015. He further submitted that on 19.09.2017, on receipt of the summons, the petitioner and other accused persons appeared before the trial court and from that date onwards, the aforesaid case is pending without any progress and therefore, he requests to direct the trial court to dispose of the aforesaid case at early. https://hcservices.ecourts.gov.in/hcservices/

3. Per Contra, the learned Additional Public Prosecutor has submitted that totally five witnesses cited on the side of the prosecution and hence, a suitable direction may be issued by fixing the time for early disposal.

4. Considering the aforesaid submissions, the learned Judicial Magistrate is directed to dispose of the case in Crime No.232 of 2015 as early as possible preferably within six months from the date of receipt of a copy of this order.

5. With the aforesaid direction, this Criminal Original Petition is disposed of.
