ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.12.2025, for the alleged offence punishable under Sections 115(2), 118(1), 296(b) and 351(3) of BNS @ 111(2)(b), 115(2), 118(1), 296(b) and 351(3) of BNS in Crime No.294 of 2025 on the file of the respondent police seeks bail. 1/4
2. The allegation against the petitioner is that, in a drunken mood, he assaulted the defacto complainant with a beer bottle on the hip. Hence, a complaint was lodged and the petitioner was arrested.
3. Learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 08.12.2025. Hence, he prays to grant bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having five previous cases pending against him. He further submitted that the injured was admitted in the hospital on 09.12.2025 and discharged on 24.12.2025. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the nature of the allegations, the fact that the petitioner is having previous antecedents and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, these Criminal Original Petition is dismissed. 12.01.2026 drl 2/4
