It is stated that the post for which the petitioner had applied was reserved for general / priority category. The petitioner belongs to Scheduled Caste community. If there was no eligible candidates available and attending the interview under general / priority category, then the respondents could have considered the application of the petitioner under the Scheduled Caste category and appointed him.

The respondents had actually appointed the petitioner and after two months of service without any notice, they removed him from service.

The reasoning given in the impunged order is that the petitioner did not belong to general / priority category. 4.

Let the learned Special Government Pleader get further instructions about placing the petitioner in any post. 5.

It is contended on behalf of the respondents that the name of the petitioner was not sponsored by the employment exchange but however in the interview notice dated 11.05.2015, there is reference of the employment exchange letter dated 08.04.2015.

Learned Special Government Pleader states that the employment exchange sponsored only two names and the petitioner's name was not there.
