ORDER
The petitioner, who was arrested and remanded to judicial custody on 19.12.2025, for the offences punishable under Section 123 of BNS R/w Section 24(1) of COTPA Act ( Section 328 of IPC) in Crime No.184 of 2025, registered on the file of the respondent police, seeks bail. 1/4
2.The case of the prosecution is that the petitioner was found in illegal possession of 112 kgs of banned tobacco products worth about Rs.1,00,000/- Hence, this case.
3.The learned counsel appearing for the petitioner submitted that a false case has been registered against the petitioner and he is in judicial custody from 19.12.2025,. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the quantity involved in this case is commercial quantity and there are two previous cases pending against the petitioner. Hence, opposed to grant bail to the petitioner. 2/4
5.Considering the fact that the quantity involved in this case is very high and there are two previous case pending against the petitioner, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition stands dismissed. 22.01.2026 smn To
