O R D E R

This petition has been filed against the docket order passed by the Court below on 09.01.2024 returning the application filed by the petitioner seeking for extension of time to deposit 20% of the compensation amount.

2. Heard Mr.S.Vijayakumar, learned counsel for petitioner and perused the materials available on record.

3. Learned counsel for petitioner submitted that the demand draft was ready and the petitioner was willing to deposit 20% of the compensation amount. In spite of the same, the Court below had returned the application.

4. Considering the facts and circumstances of the case, there shall be a direction to the petitioner to deposit 20% of the compensation amount as directed by the Court below on or before 29.01.2024. On such deposit, the condition imposed by the Court below shall be deemed to have been complied with. The petitioner shall comply with the other conditions imposed by the Court below while suspending the sentence. If any non-bailable warrant has been issued, the same shall also be recalled in view of this order passed in the present petition.

5. This Criminal Original Petition is disposed of in the above terms.

Registry is directed to return the original application to learned counsel for petitioner.
