The petitioner, who was arrested and remanded to judicial custody on 15.12.2022 for the alleged offence under Sections 406, 420 294(b), 506(i) of IPC in Crime No.556 of 2022 on the file of the respondent police, seeks bail.
2. The case of prosecution is that the defacto complainant and the petitioner have entered into an lease agreement and the defacto complainant had also paid a sum of Rs.9 lakhs to her. However, after receiving the money, the petitioner has refused to hand over the possession. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and that a case of financial dispute has been falsely projected as a case of cheating. He further submitted that the petitioner has been falsely implicated in this case and she has been suffering
incarceration from 15.12.2022. Hence, he prayed to grant bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for respondent submitted that there was some transaction between the defacto complainant and the petitioner. He further submitted that there are four cases similar in nature pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioner.
5.The learned counsel for the intervenor raised objection stating that the petitioner borrowed a sum of Rs.11 lakhs and refused to hand over the possession nor she repaid the amount.
6. Taking into consideration the gravity of offence committed by the petitioner and also the bad antecedent of the petitioner and it is stated that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
7.Accordingly, this Criminal Original Petition stands dismissed. 12.01.2023 vkr
