ORDER
This Writ Petition has been filed for issuance of a Writ of Certiorarified Mandamus, calling for the entire records pertaining to the order of 2nd Respondent in Enn.19201/ V2/ 2009- 2 dated 31.08.2024 and to quash the same as illegal and consequently, direct the respondents 2 to 4 to grant entire pending pension to petitioner as well as entire gratuity benefits to petitioner.
2. Mr.Stalin Abimanyu, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.
3. The case of the petitioner is that he served in the Registration Department for nearly 30 years and lastly worked as Office Assistant in the Sub-Registrar Office, Pernampattu. A Criminal case in Crime No.8 of 2009 was registered against him and others for offences under Section 109 IPC and Sections 7, 13(2) read with 13(1)(d) of the Prevention of Corruption Act. It is his further case that after full-fledged trial, the learned Special Court, Chief Judicial Magistrate, Vellore, in Special Case No.1 of 2011, by judgment dated 05.11.2019, acquitted all the accused holding that the prosecution failed to prove the charges beyond reasonable doubt and no appeal was filed against the said judgment, thereby the same attained finality.
It is the further case that thereafter departmental proceedings were initiated against him under Rule 17(b) of the Tamil Nadu Civil Services (Disciplinary and Appeal) Rules. The Enquiry Officer, after conducting enquiry, found that the charges against the petitioner were not proved. However, the disciplinary authority disagreed with the findings of the Enquiry Officer and imposed the punishment of compulsory retirement and restricted pensionary benefits. Aggrieved by the said order, the petitioner preferred an appeal dated 14.10.2025 before the competent authority. Since the said appeal is still pending consideration, the petitioner has filed the present Writ Petition.
4. Learned counsel for the petitioner submitted that the petitioner was acquitted in the criminal case and the Enquiry Officer had also held that the
charges were not proved. However, the disciplinary authority imposed punishment and the statutory appeal filed by the petitioner dated 14.10.2025 is still pending. Hence, he prayed for issuance of a direction to the first respondent to dispose of the said appeal within a time limit fixed by this Court.
5. Learned Additional Government Pleader appearing for the respondents submitted that the appeal filed by the petitioner dated 14.10.2025 is pending consideration and the same will be disposed of in accordance with law.
6. Considering the facts and circumstances of the case, this Court directs the first respondent herein to dispose of the appeal dated 14.10.2024 within a period of six (6) weeks from the date of receipt of a copy of this order.
7. Accordingly, this Writ Petition stands disposed of. No Costs. Consequently, connected miscellaneous petitions are closed. 03-02-2026 Index: Yes/No Speaking/Non-speaking order ANU
