This Petition has been filed to condone the delay of 1547 days in filing the above Appeal Suit against the Judgment and Decree passed in O.S.No.167 of 2012 dated 05.10.2017 on the file of the Sessions Court (Fast Track Mahila) at Namakkal.

2. Heard the learned counsel for the appellants and the learned counsel for the respondents and also perused the materials available on record.

3. On seeing the facts of the case that the 1st respondent has given birth to two children, and the learned Sessions Judge, (Fast Track Mahila), Namakkal, ordered compensation of Rs.1,50,000/- vide dated 5.10.2017, in O.S.No.167 of 2012. This Court is inclined to condone the delay of 1764 days in filing this first appeal, on deposit of Rs.1,00,000/- towards part of the decree amount, within a period of four weeks from the date of receipt of a copy of this order.

4. The Registry is directed to number the Appeal Suit, if the papers are otherwise in order.

5. Issue notice to the respondents to the correct address returnable by 13.06.2023 or through police.

6. Post the matter on 13.06.2023.
