CMP.Nos.1070, 1071 & 1072 of 2011 in S.A.No.50 of 2005 CMP.Nos.1070, 1071 & 1072 of 2011 in S.A.No.50 of 2005 RMT.TEEKAA RAMAN,J., CMP.No.1070 of 2011, has been filed to condone the delay of 1702 days in filing the petition to set aside the abatement in the above S.A.No.50 of 2005, CMP.No.1071 of 2011 has been filed to set aside the abatement caused due to the death of the first respondent viz., Sivananda Udayar in the above second appeal and CMP.No.1072 of 2011 has been filed to bring on record the respondents 3 to 5 herein as legal representatives of the first respondent/deceased and to record the second respondent viz., Poovayammal as the legal representative of the deceased in S.A.No.50 of 2005. 2.Proposed parties were served. Name printed in the cause list. None appeared.

3.The factum of the death and the proposed parties as his legal representatives, are not in dispute.

4.Considering the submissions made by the learned counsel for the appellants and being satisfied with the reasons stated in the affidavit filed in support of these applications, all these petitions are allowed. 5.The Registry is directed to carry out necessary amendments in the cause title within a period of three weeks.
