ORDER

This Criminal Original Petition has been filed to transfer the investigation in Crime No.44 of 2008 from the 3rd respondent to any other investigation agency under the supervision of the Deputy Commissioner of Police to investigate the matter and to submit the final report within stipulated time.

2.Heard, M.Subash Babu, learned counsel appearing for the petitioner and Mr.M.Mohamed Riyaz, learned Additional Public Prosecutor for the respondents 1 to 3 and perused the materials available on record.

3.The learned Additional Public Prosecutor would submit that the respondent police is conducting investigation and the same is yet to be disposed of. 4.Considering the facts and circumstances of the case, this Court does not want to interfere with the investigation at this stage. However, the third respondent Police is directed to complete the investigation in Crime No.44 of 2008, pending on his file and file a final report within a period of four weeks from the date of the receipt of a copy of this Order.

5.With the above direction, the Criminal Original Petition is disposed of.
