Sandhya ...Defendants (Minors 8 to 10 represented by mother and natural guardian Balamani alias Bala) Prayer: Transfer Civil Suit has been filed praying for a) partition and separate possession of the half share of the plaintiffs in house and ground bearing Door No.10, Old Door No.21, Perumal Koil Garden 3rd Lane, Peddunaickenpet Chennai 79, and lands at Keezh 1/4
Sembudu Village, Vandavasi Taluk, Thiruvannamalai, Sambuvarayar District;
b) for appointment of Commissioner of effect partition and put the plaintiffs in possession of their half share in the schedule mentioned properties and for ascertainment of mesne profits from date of plaint till the date of delivery of separate possession and the plaintiffs undertake to pay necessary court fees for the same.
c) for permanent injunction restraining the defendants from interfering with the plaintiffs lawful possession and enjoyment of the suit property and also to restrain the defendants from alienating the suit property;
d) to appoint a receiver and to take possession of the suit properties for administration and for collecting rent and properties till separate possession is given and e) costs of the suit.
For Plaintiff : No appearance For Defendant : No appearance J U D G E M E N T Earlier, when the Suit was posted on 21.12.2024 for hearing, there was no representation for the plaintiff. Hence, the Registry was directed to print the name of the plaintiff in the cause-list and post this matter today under the caption, 'for dismissal' and accordingly, it is listed today. 2/4
2. Even today, inspite of the name of the plaintiff being printed in the cause-list, the plaintiff has not chosen to appear before this court either in person or through counsel on record. Hence, this Suit is dismissed for nonprosecution. No costs. Gv 03.01.2025 3/4
