ORDER

This Petition has been filed seeking a direction to the 1st respondent to transfer the investigation of the case in Crime no.1 of 2025 on the file of the 2nd respondent to any other Investigating agency to conduct proper and effective investigation on the petitioner's complaint dated 04.11.2024 in accordance with law.

2.The petitioner is the defacto complainant and on a complaint lodged by her, the second respondent has registered an FIR in crime no.1 of 2025 for the offence under Section 69 of BNS, 2023. Now, the investigation is pending. In fact, after registration of FIR, the petitioner's statement is also recorded under Section 164 of Cr.P.C., before the concerned Judicial Magistrate. Thereafter, it is reported that the petitioner failed to co-operate for the investigation and as such, it is pending without filing a final report. 2/4

3. In view of the above, there is absolutely no reason to transfer the investigation from the file of the second respondent to any other Investigating Agency. However, the second respondent is directed to complete the investigation and file a final report in Crime no.1 of 2025 forthwith. The first respondent is directed to monitor the investigation done by the second respondent and ensure that the second respondent shall comply with the direction issued by this Court. 4.This Criminal Original Petition is disposed of, with the above direction.
