O R D E R

This writ petition is filed for issuance of Mandamus directing the 2nd respondent for reimbursement of his approved medical expenses of a sum of Rs.2,00,675/- with prevailing rate of interest and to disburse the same forthwith in pursuance of the communication issued by the 1st respondent dated 05.04.2021 made in Rc.No.5060/NHIS-3/2021 to the 2nd respondent.

2. When the matter is taken up for hearing, the learned Government Advocate appearing for the respondents filed a counter affidavit dated 31.03.2022 before this Court stating that the claim of the writ petitioner has been assessed and settled. The relevant portion of the counter affidavit reads thus:-

In this connection, it is further submitted that the United Insurance Company stated in their E-mail dated 02.03.2022 that the claim of the writ petitioner has been assessed and settled for Rs.1,38,389/- and the amount has been credited in the account of the petitioner vide UTR No.22225079797 dated 06.02.2022. In view of the submissions made supra, it is submitted that the claim of the petitioner for reimbursement of medical expenses

has been processed and the eligible amount has been settled to the writ petitioner viz., Thiru.K.Dharmalingam by the 2nd respondent i.e., the United India Insurance Company. Hence, the prayer of the petitioner has been complied with.

Therefore, it is prayed that this Hon'ble Court may be pleased to dismiss the W.P.No.800 of 2022 with cost and thus render justice.

3. In view of the submission made by the learned Government Advocate appearing for the respondents and recording the counter affidavit filed by the respondents this writ petition is closed. No costs. 05.04.2024 Index : Yes/No Speaking order/Non-speaking order dpq To
