ORDER

This Criminal Original Petition has been filed by the petitioners to quash the final report pending against them in C.C.No.15119 of 2008, before the learned 10th Metropolitan Magistrate, Egmore, Chennai.

2. When the matter is taken up for hearing today, the learned counsel for the petitioners sought permission of this Court to withdraw this criminal original petition and has also made an endorsement to that effect.

3. In view of the above submission and the endorsement made, this criminal original petition is dismissed as withdrawn. However, considering the age of the proceedings, the trial Court is directed to dispose of the proceedings in C.C.No.15119 of 2008 within a period of four months from the date of receipt of a copy of this order.

4. At this juncture, the learned counsel for the petitioners sought the indulgence of this Court to dispense with the https://hcservices.ecourts.gov.in/hcservices/

personal appearance of the first petitioner, citing her health conditions. Considering the facts and circumstances of the case and the nature of offence, the personal appearance of the first petitioner alone, before the trial Court, is dispensed with, provided, the first petitioner shall file an affidavit before the learned 10th Metropolitan Magistrate, Egmore, Chennai, undertaking that she will appear before the Court as and when her presence is required.
