ORDER

This Writ Petition has been filed seeking a direction to the respondents to dispose the petitioner's representation dated 25.11.2024 in the light of the Government Order in G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022 to reinstate the petitioner to the post of Village Administrative Officer, Kattalai Village, Tindivanam Taluk, Villupuram District.

2. The case of the petitioner is that, he was working as Village Administrative Officer from 01.10.2022 under the control of the 2nd respondent. Meantime, the 3rd respondent registered Crime No.05/2024/AC/VPM, under Section 7 of the Prevention of Corruption Act, 1988 against the petitioner. Thereafter, he was arrested and remanded to judicial custody. The 2nd respondent further issued suspension order against him in R.C.No.A1/3910/2024, on 20.08.2024. Hence, the petitioner made a representation dated 25.11.2024 to the 2nd 2/6

and 3rd respondents to revoke the suspension order and reinstate him. The representation is not considered so far by the respondents. Hence, the present writ petition has been filed.

The learned counsel appearing for the petitioner would submit that, In the Government order in G.O.(Ms).No.81, HRM(N) Dept. dated 04.08.2022, instructions have been issued in respect of disciplinary cases for review of suspension pending enquiry into grave charges and time limit has been issued for finalization of disciplinary proceedings. However, the same has not been followed by the respondents in the case of the petitioner herein and he is kept under suspension from 20.08.2024 onwards.

In view of the above submission, there shall be a direction to the 2nd respondent to consider the representation of the petitioner and dispose of the same, in the light of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, within a period of eight weeks from the date of receipt of a copy of this order. 3/6
