ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioners who were arrested and remanded to judicial custody on 22.11.2021 for the offence under Section 302 of IPC, in Crime No.613 of 2021 on the file of the respondent police seek bail.

2. The case of the prosecution is that the deceased and A1's wife had illegal affair. Hence, on 21.11.2021 the petitioner/A1 along with A2, after consuming alcohol stabbed the deceased with the bottle and murdered the deceased. Hence, the complaint.

3. The learned Counsel for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case and that they have been suffering incarceration for about 59 days from 22.11.2021. Hence, he seek for grant of bail to the petitioners.

4. The learned Additional Public Prosecutor raised strong objection stating that there are totally 2 accused in this case and they both have been arrested. The wife of A1 was having illegal affair with the deceased and hence, the petitioners after consuming https://hcservices.ecourts.gov.in/hcservices/

alcohol stabbed the deceased with the bottle committed the murdered and that the investigation has not been completed.

5. On seeing the gravity of offence committed by the petitioners and that the investigation has not been completed, this Court is not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
