The petitioners have filed this petition seeking to call for the records in C.C.No.5132 of 2014 on the file of the IV Metropolitan Magistrate, Saidapet, Chennai and quash the same.
2. When the matter is taken up for hearing, learned counsel for the petitioners submitted that the petitioners are not inclined to proceed with the present petition and they are ready to face the trial. He further submitted that, it would suffice, if this Court issues a direction to the Trial Court to expedite the trial and complete the same as early as possible. He furthermore submitted that that the appearance of the petitioners before the Trial Court may be dispensed with.
3. In view of the above, the Trial Court is directed to dispose of C.C.No.5132/2014 as expeditiously as possible as per seniority of the case. The petitioners and respondent are directed to co-operate with the trial court for the early completion of trial. Further, taking into consideration the 3/6
request as made by the learned counsel for the petitioners, the petitioners' appearance before the trial court is dispensed with except for their appearance for the purpose of receiving the copy of the proceedings u/s 207 Cr.P.C, framing of charges, questioning under Section 313 Cr.P.C. and on the day on which judgment is to be pronounced. However, if for any particular reason, the presence of the petitioners is necessary, the trial court, at its wisdom, shall direct their appearance on those days.
4. With the above observations, this Criminal original petition is disposed of. Consequently, connected Miscellaneous petition is closed. 25.01.2023 (1/2) skt Speaking Order : Yes/ No Index : Yes/ No To 1.
