2. The petitioner has filed these writ petitions challenging the orders dated 18.01.2018 and 17.01.2018 respectively, which https://hcservices.ecourts.gov.in/hcservices/

have been passed pursuant to random selection for detailed scrutiny under section 22(3) of Tamil Nadu Value Added Tax Act, 2006.

3. If the power under section 22(3) of the Act is invoked, then, the assessee has been deemed to have been assessed in terms of section 22(2) of the Act. Thus, if the respondent proposes to revise the assessment upon a case being taken up for random scrutiny, necessarily, notice and the procedure contemplated under Section 27 of the said Act has to be followed. In these circumstances, the impugned orders are not sustainable.

4. In view of the above, the writ petitions are allowed and the impugned orders are set aside and the matters are remitted back to the respondent, who shall issue appropriate notice invoking the statutory provisions and proceed in accordance with law. No costs. Consequently, connected miscellaneous petitions are closed.
