Respondent Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the Respondent to consider the petitioner's representation dated 19.04.2023 and pass suitable orders based on M.D.Work order No.315/GM(M)/19, 316/GM(M)/19, 317/GM(M)/19. 318/GM(M)19, dated 07.01.2020 and release the outstanding payments to the petitioner expeditiously along with interest calculated from the invoice dated 11.03.2020 and 16.03.2020 till date of realization. ORDER

The petitioner is a proprietary concern which is registered under Micro Small & Medium Enterprises (MSME) and it involved in the business of out door advertising and marketing. As per the work order given by the respondent, the petitioner had invested a huge sum in executing the work order and making advertisements as required. But the respondent did not settle the bill due. Hence, this Writ Petition.

2. Heard Mr.A.Ilangovan, learned counsel for the petitioner and Mr.V.Rajinikanth, learned Standing counsel appearing for the Respondent.

3. Mr.A.Ilangovan, learned counsel for the petitioner submitted that as on today, there is an outstanding of Rs.18,88,000/- due to be payable by the Respondent. The petitioner has submitted the invoice for the said amount. So far, no action has been taken by the respondent to settle the outstanding payment to the petitioner. In this regard, the petitioner made representation on 19.04.2023 and the same was not considered yet. Hence,

the petitioner has filed the present Writ Petition.

4. The petitioner who has executed the work order of the respondent should not be made to wait for more than four years. The Work orders seems to be executed as early as in the year 2020 and the petitioner has raised invoice on 07.01.2020. The inordinate delay on the part of the respondent in settling the payment to the petitioner, affects the business of the petitioner.

5. Hence, this Writ Petition is allowed. The respondents are directed to consider the representation of the petitioner, 19.04.2023 and pass orders to realise the eligible outstanding amount due to the petitioner, on merits, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
