JUDGMENT
The above Civil Miscellaneous Appeal has been filed against the against the order of the learned Principal District Judge, Chengleput made in Arbitration Original Petition No.216 of 2002 dated 04.03.2011 under Section 34 of the Arbitration and Conciliation Act.
2. This Court, by order dated 19.08.2011, upon hearing the learned counsel for the appellant, ordered notice of motion to the respondents and the matter was adjourned by four weeks.
3. Further, on 31.03.2022, when the matter was taken up for hearing, despite, the name of the appellant as well as the counsel on record being printed in the cause-list, there was no representation on behalf of the appellant and hence, this Court, https://hcservices.ecourts.gov.in/hcservices/
adjourned the case to 07.04.2022 under the caption "for dismissal".
4. Today(07.04.2022), when the matter is taken up for hearing, neither the appellant appeared in person nor his counsel appeared on their behalf to represent the case. It can now be inferred that the appellant is not interested to prosecute this Civil Miscellaneous Appeal. Accordingly, this Civil Miscellaneous Appeal is dismissed for non-prosecution.
