Mr.A.Selvendran, learned Special Government Pleader accepts notice for the respondents. Since this writ petition is being disposed of without passing any adverse orders against 3rd respondent, affecting his interest, notice to 3rd respondent is dispensed with.

2. This writ petition has been filed seeking for issuance of a writ of mandamus, directing the first respondent to consider and pass orders on the petitioner's appeal dated 16.11.2023 filed against the order of the second respondent made in Moo.Mo.B2/486/2023 dated 06.11.2023 and keep the order of the second respondent in abeyance till the disposal of the petitioner's appeal.

3. The learned counsel for the petitioner submitted that as against the order passed by the second respondent dated 06.11.2023, the petitioner has Pg.Nos.2/5

preferred an appeal before the first respondent on 16.11.2023. Though the first respondent has called for the records from the second respondent, till date, the petitioner has not been called for enquiry for hearing of the appeal and the same is pending. Hence, the petitioner is constrained to file the present writ petition.

Therefore, this Court, without expressing any opinion with regard to the merits of the case, directs the first respondent to dispose of the appeal dated 16.11.2023, on merits and in accordance with law, after giving due opportunity of hearing to the petitioner herein and the third respondent herein as well as rival claimants/interested parties, if any, within a period of three months from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
