This Civil Revision Petition is filed under Article 227 of the Constitution of India praying to set aside the order and decreetal order dated 03.09.2009 passed in I.A.No.8823 of 2009 in O.S.No.5002 of 2008 on the file of the learned XI Assistant Judge, City Civil Court, Chennai.

The learned counsel appearing for the respondents 3 & 4 submitted that the suit is one for permanent injunction filed by the respondents 1 & 2 herein in which the revision petitioner had filed an Interlocutory Application in I.A.No.8823 of 2009 seeking for appointing an Advocate Commissioner to inspect the suit property and the same came to be dismissed on 03.09.2009. He also submitted that the tenants who had filed the suit has vacated the premises.
2. In view of the submission made by the learned counsel for respondents 3 & 4, nothing survives in this Civil Revision Petition for further adjudication and the same is dismissed as "infructuous" by this Court. No costs. Consequently, connected Miscellaneous Petition is closed.
