The petitioner, who is arrayed as A5, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6[4] of Tamil Nadu Schedule Commodities [Regulation of Distribution through Card System] Order 1982 r/w Section 7[1][a][i] of Essential Commodities Act, 1955, on the file of the respondent police, in Crime No.75 of 2016, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in possession of 50 bags of P.D.S. black gram.

3. Learned counsel appearing for the petitioner submits that the petitioner is an innocent lady and she is no way connected with the alleged offence and therefore, she may be granted anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent opposed this application contending that the petitioner being an employee of the ration shop sold the P.D.S. black gram to the other accused and the other accused were already been arrested and that the investigation is pending.

5. The petitioner being an employee of the ration shop sold the black gram to the smugglers, which is meant for distribution to the public and thus, encouraged blackmarketing. Considering the nature and gravity of the offence, role of the petitioner in this offence, this Court is not inclined to grant anticipatory bail and this petition stands dismissed.
