Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 1st respondent to consider and pass orders on the representation dated 17.02.2017 to cancel the order to re-do the 5th Semester and grant permission to appear for the 6th Semester to be held on May 2017 along with the missed exams of the 5th Semester in the college of the 2nd respondent.

O R D E R

This Writ Petition has been filed seeking for a direction to the first respondent to consider and pass orders on the representation dated 17.02.2017.

2. Heard Mr.G.Mohanakrishnan, learned counsel appearing for the petitioner as well as Mr.L.P.Shanmugasundaram, learned counsel appearing for the respondents.

3. The case of the petitioner is that the petitioner secured admission on merit for the B.L., 3 years course for the year 2014-15 and was allotted a seat in the second respondent's college and joined there. During the fifth semester, due to his ill health, afflicted with Jaundice, he remained at Chennai for taking treatment and therefore he was unable to secure the https://hcservices.ecourts.gov.in/hcservices/

required attendance. Therefore, the petitioner had submitted Medical Certificate along with all test reports to the second respondent. But the second respondent did not permit him to appear for the fifth semester examination and asked him to re-do the fifth semester for want of minimum attendance. Hence, the petitioner submitted a representation dated 17.02.2017 to the first respondent, requesting to permit him to appear for all the exams he missed in the fifth semester and also the forthcoming exams for the sixth semester. Since, the same has not evoked any response, the petitioner has come forward with this Writ Petition seeking for the aforesaid relief.

4. The learned counsel for the respondents has no objection for this Court passing an order, directing the first respondent to consider the representation of the petitioner, within a stipulated time.

5. Considering the submissions made by the learned counsel appearing on either side, without expressing any opinion on the merits of the case, the first respondent is directed to consider and dispose of the representation of the petitioner, dated 17.02.2017, on merits and in accordance with law and pass orders, within a period of one week from the date of receipt of this order and communicate the decision taken to the petitioner.
