ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 118(1), 351(3) and 303(2) of BNS 2023 in connection with the Cr.No.472 of 2025, seeks anticipatory bail.

2. The allegations against the petitioner are that the petitioner, who is the husband of the de facto complainant, demanded money for buying new car. When the de facto complainant refused, the petitioner allegedly assaulted her with a hammer, causing severe head injuries. Subsequently, the petitioner broke into the bureau and took ₹20,000/- and gold jewelry and threatened her with dire consequences. Consequently, the present case has been registered.

The learned counsel for the petitioner would submit that the defacto complainant who is the wife of petitioner, has lodged a false complaint due to matrimonial discord and prior disputes between them. He also contends that alleged injuries were the result of an earlier accident and not due to any assault as falsely projected and the jewels in question were already pledged by the defacto complainant and the petitioner also undertakes to cooperate with the investigation, and seeks for grant of anticipatory bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instructions submitted that the defacto complainant sustained grievous injuries in the occurrence and is presently undergoing treatment. Stating the seriousness of the allegations and the stage of investigation, the learned Government Advocate strongly opposed for grant of anticipatory bail to the petitioner.

5. Considering the gravity of offence, the nature of injuries sustained by the defacto complainant, who is still undergoing treatment and the fact that investigation is in progress, this Court is not inclined to grant the relief of anticipatory bail to the petitioner.
