Mr.K.Ganeshan Also Known As K.Ganesan v. No Respondent

O.P.No. 108 of 2024 C.V.KARTHIKEYAN, J.

The petitioner seeks probate of a Will executed by R.Ramakrishnan, the paternal uncle of the petitioner, who died on 10.09.2006. He had executed a Will on 24.06.2002.

2. The petitioner is the Executor under the Will and also the Legate under the Will. The wife of the deceased Sharadambal had died on 26.08.2015.

3. The learned counsel for the petitioner stated that there are no other relatives, who could be reasonably stated to have caveatable interest with respect to the grant of probate of the Will.

4. After following due procedure, the petitioner was directed to tender evidence. Accordingly, the petitioner examined himself as PW-1 and marked the original Will dated 24.06.2002 as Ex.P-2 and the death certificate of the Testator of R.Ramakrishnan as Ex.P-4 and the death certificate of wife of the testator R.Sharadambal as Ex.P-5 and Class-II https://www.mhc.tn.gov.in/judis

legal heirship certificate as Ex.P-6. The affidavit of assets have been C.V.KARTHIKEYAN, J.

vsg marked as Ex.P-8 and the document relating to the property had been marked as Ex.P-1. Additionally the petitioner also examined as PW-2 as one of the attesting witness, who identified the Will and also stated that at the time of execution, the testator was in a sound and disposing state of mind and also stated that the attestor and testator were present at that point of time. They all signed at the same time.

Taking the nature of evidence into consideration, this Original Petition stands allowed. The probate is granted in accordance with the rules.
