O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120b, 406, 417, 420, 468, 471 of IPC, in Crime No.13 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that the petitioner joined hands with the other accused, promised to sell the land belongs to them and obtained a sum of Rs.61.50 lakhs from the defacto complainant through the bank transactions. Hence, this case.

The learned counsel appearing for the petitioner would submit that this is second anticipatory bail application and the earlier criminal original petitions in Crl.O.P.No.35026 of 2025 seeking anticipatory bail was dismissed by this Court on 05.01.2026. He further submitted that the petitioner is innocent and has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that A1 colluded with this petitioner and collected huge amount and the investigation is pending. 5.The first anticipatory bail application in Crl.O.P.No.35026 of 2025 has been dismissed by this Court by an order dated 05.01.2026 on the following reasons:

"6.Considering the fact that huge amount of Rs.75 lakhs have been collected from the defacto complainant herein claiming that they have saleable interest in some lands however it revealed that there was no such lands and this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed."

Heard the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the fact that there is no change in the circumstances, this Court is not inclined to revisit the earlier order. Accordingly, this criminal original petition stands dismissed.
