( Criminal Jurisdiction ) Wednesday, the First day of August Two Thousand Eighteen PRESENT The Hon`ble Mr Justice RMT.TEEKAA RAMAN CRIMINAL MISCELLANEOUS PETITION No.10193 of 2018 IN CRL RC.584/2018 S.VASANTHA [ PETITIONER ] Vs S.UDAYARAJ [ RESPONDENT ] Petition praying that in the circumstances stated therein the High Court will be pleased to extend the time in the order made Crl.M.P.No. 6885 of 2018 in Crl.R.C.No 584 of 2018 dated 28/04/2018 for executing sureties and pass any other orders as this Honble court.[CRL.MP.NO.10193/2018] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.C.D.JOHNSON Advocate for the petitioner and of MR.I.C.VASUDEVAN Advocate on behalf of the Respondent the court made the following order:- This petition is filed seeking to extend the time granted in the order dated 28.04.2018 made in Crl.M.P.No.6885 of 2018 in Crl.R.C.No.584 of 2018 for executing sureties.
2. This Court, by an order dated 28.04.2018, has granted interim suspension of sentence to the petitioner on condition that she shall deposit a sum of Rs.1,00,000/- before the trial Court on or before 11.06.2018 and to execute bond for a sum of Rs.10,000/- with two sureties.
3. Today, the learned counsel appearing for the petitioner would submit that due to financial conditions, the petitioner was unable to mobilize the fund and hence, seeks for extension of time.
4. Learned counsel for the respondent has got no objection for extending the time.
5. After hearing both the parties, the time limit fixed by this Court in the earlier order dated 28.04.2018 to the effect that the petitioner shall deposit Rs.1,00,000/- on or before 11.06.2018 is hereby extended to 11.08.2018. Now, it is also represented that the petitioner was taken into custody.
6. In view of the subsequent development, the petitioner shall be released on bail on her executing a bond for a sum of Rs.10,000/- https://hcservices.ecourts.gov.in/hcservices/
(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned [*]Judicial Magistrate,Fast Track Court No.I, Erode, and on such release, the petitioner has to mobilize the fund and deposit the same before the [*]Judicial Magistrate,Fast Track Court No.I, Erode on or before 11.08.2018 and on further condition that the petitioner shall report before the said Court on the first working day of every month at 10.30 a.m till the disposal of the revision.
