ORDER

This writ petition has been filed by the petitioner to consider the representation dated 02.09.2022.

Learned counsel for the petitioner would submit that the petitioner has made a representation dated 02.09.2022 to provide details pertaining to the stage of completion of the tender said to have been completed by Juniper Networks Solution India Private Limited. However, the said representation was not considered by the respondents, as on date. Hence, this writ petition.

Learned senior standing counsel appearing for the respondents would submit that the petitioner has sought similar information before the Central Public Information Officer of the first respondent and the same was rejected on 09.09.2020, against which, the petitioner preferred first appeal before the first appellate authority of the first respondent, but the said appeal was dismissed on 10.11.2020. Subsequently, they preferred second appeal under Section 19(3) of the Right to Information Act, 2005, before the second appellate authority and that was also dismissed on 07.06.2022. Without challenging the aforesaid

rejection/dismissal orders, the petitioner has filed this writ petition, as if their representation was not considered. Hence, he prays for dismissal of this writ petition.

4. Heard the learned counsel on either side and perused the materials available on record.

In the present case, by virtue of the representation dated 02.09.2022, the petitioner sought information from the respondents pertaining to the stage of completion of the tender said to have been completed by Juniper Networks Solution India Private Limited. However, the same was not considered. Hence, this writ petition. In the present case, it appears that, whatever the information sought by virtue of the representation dated 02.09.2022, the same was already requested by the petitioner and the Information Officer has also rejected the said request on 09.09.2020. Thereafter, the petitioner has preferred first appeal before the first appellate authority, however, the same was dismissed on 10.11.2020, against which second appeal was also filed under Section 19(3) of the Right to Information Act, 2005, which was also rejected on 07.06.2020 and no challenge has been made against the aforesaid dismissal orders.

6. In view of the above, it is clear and evident that whatever the information sought by the petitioner has already been rejected by the

Information Officer. Now, by virtue of the aforesaid representation dated 02.09.2022, again the petitioner is trying to get the same information, which is legally impermissible.

As rightly contended by the learned senior standing counsel, the right course available to the petitioner is to challenge the dismissal orders in the manner know to law, however without evoking such relief, the petitioner has filed this writ petition for the very same information, after a period of four years from the date of initial rejection of his application i.e., 09.09.2020.

8. Therefore, this writ petition is liable to be dismissed for abusing the process of Court.

In the result, this writ petition stands dismissed with a cost of Rs.25,000/-(Rupees Twenty Five Thousand Only) to the credit of The Principal, Government Naturopathy Medical College and Hospital [Account No.7883022723, IFSC Code:IDIB000M157], within a period of four weeks from the date of receipt of a copy of this order.
