This petition is filed under Section 482 of Criminal Procedure Code to call for records in CC No.860 of 2010 on the file of the Judicial Magistrate, Tambaram and to quash the same.

ORDER

This petition is filed to quash the final report filed against the petitioner in C.C.No.860 of 2010 on the file of Judicial Magistrate, Tambaram. The petitioner is the accused in Crime No.860 of 2010, wherein, he was charged for the offence punishable under Section 406, 420 of IPC.

2. When the matter is taken up for hearing, the learned Government Advocate submit that the trial Court had already proceeded with the trial and out of 6 witnesses, 5 witnesses have already been examined. The case in C.C.No.860 of 2010 is posted for further evidence.

Since most of the witnesses have already been examined and only one more witnesses alone is yet to be examined, I am inclined to dismiss this application with a liberty to the petitioner to raise all the points raised before this Court, before the learned Judicial Magistrate Court, Tambaram and the learned Judicial Magistrate, Tambaram is directed to conclude the process of trial within a period of three months from the date of receipt of copy of this order.
