Crl.O.P.No.10426 of 2016 P.KALAIYARASAN, J.

The petitioner, who was arrested and remanded to judicial custody on 02.03.2016 for the alleged offences under Sections 147, 148, 452, 341, 324, 307 and 506(ii) of IPC, in S.C No.238 of 2014 on the file of VII Additional Sessions Judge, Chennai, seeks bail.

2. Heard both sides.

3.The learned counsel for the petitioner submits that the petitioner is innocent of the charges framed against him and would further submit that the case is posted for examination of further witnesses after examination of 7 witnesses and would further submit that the petitioner is having permanent residence and therefore, prays that the petitioner may be enlarged on bail.

4.The learned Additional Public Prosecutor opposed this application contending that the petitioner used to abstain himself whenever witnesses were present and if he is released on bail, the case will be unnecessarily pending.

5. Admittedly, 7 witnesses on the side of the prosecution have

kua been examined and therefore, there will be only few witnesses to be examined. Considering the stage of the case and the fact that the petitioner used to abstain himself whenever witnesses were present, this Court is not inclined to grant bail to the petitioner.

6. Hence, this Petition is dismissed. However, the trial Court is directed to dispose of the case expeditiously. 04.05.2016 kua Crl.O.P.No.10426 of 2016
