Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the second respondent to complete the enquiry and pass appropriate orders in the enquiry proceeding No.15852/U1/U6/2023 within a short stipulated time on the basis of petitioner's representation dated 01.01.2024. ORDER

This writ petition is filed seeking for a mandamus directing the second respondent to complete the enquiry and pass appropriate orders in the proceeding No.15852/U1/U6/2023 within a stipulated time on the basis of petitioner's representation dated 01.01.2024. It is submitted by the learned counsel for the petitioner that the petitioner belongs to schedule caste community and he is a farmer by profession. The lands situated in Karadivalipudhur village, Paruvai Revenue village, Palladam Taluk, Tiruppur District in survey nos. 145/2A2, 145/2A6, 146/2A1, 145/2A5,154/2A8,146/2B2,146/2A2 were originally assigned to Karuppuysamy C.Araan, A.Pannari and N.Palani, 2/6

M.Arran, B.Palani and others, who belong to schedule class community in proceedings No.4671/1986 dated 12.06.1986 and in MR4/4079/G AON 946, dated 09.09.1985. The said land was assigned free of cost with a condition not to alienate the said lands for a period of 10 years and with further condition that even after completion of 10 years the said lands are required to be alienated only to the persons belonging to schedule caste community, however, said lands were erroneously transferred in favour of the sixth respondent with the help of a power agent.

It is further submitted by the learned counsel for the petitioner that the petitioner questioning the same has filed a writ petition in W.P.No.9128 of 2023 wherein, this Court by an order dated 27.03.2023 has directed the first respondent therein to consider the petitioner's representation dated 11.01.2023. Enquiry as sought for by the petitioner has though stated to have been initiated by the second respondent, it is still pending and thereby the petitioner sought for a mandamus directing the second respondent to conclude the enquiry proceedings in No.15852/U1/U6/2023.

The learned Additional Government Pleader who has taken notice for the respondents one to five and submitted that the petitioner's representation dated 07.08.2023 will be considered and disposed of within a short time.

Considering the limited scope of relief sought for by the petitioner and on considering the submission of the learned Additional Government Pleader, this writ petition is disposed of directing the second respondent to consider the petitioner's representation dated 01.01.2024 and complete the enquiry in the manner know to law, as quickly as possible at any rate not later than six weeks from the date of receipt of a copy of this order. No costs.
