ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for alleged offences punishable under Sections 303(2) of BNS in Crime No.76 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The allegation in this case is that the petitioner herein joining hands with other two accused was involved in the theft of copper wire from the transformer, valued at Rs.1,50,000/-. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner herein is ranked as A1 in this case and has been falsely implicated in this case, on the basis of the confession statement given by the other accused. Further, he submitted that the investigation is almost over and that the petitioner is also ready to abide by any condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate appearing for the respondent police reiterated the prosecution case and submitted that A2 and A3 were arrested and however, no stolen property has been recovered. It is stated by the arrested accused that the stolen property was handed over to the petitioner herein, and the investigation in this case is still pending. Hence, she vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the allegation and the fact that so far, no stolen property has been recovered and that the petitioner herein is alleged to be in possession of the stolen property, which is yet to be recovered, this Court is

not inclined to grant anticipatory bail to the petitioner.
