ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 318(4) of BNS in Crime No. 418 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner has collected gold weighing 141 grams by promising that he will convert it into gold jewels and return it back to defacto complainant, however whenever he was asked to return back, he avoided returning the gold and slowly started disconnecting the phone and subsequently absconded. Thereafter, the defacto complainant has also approached the Commissioner's office and a petition enquiry was conducted and in which also the petitioner appeared and promised to return back, however, failed to return back the cash or gold. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner herein has not cheated the de facto complainant, that due to business loss he was not able to return back the gold and submitted that it is a case of civil nature. Therefore, prayed for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that so far no gold jewels were recovered or no money is paid and the investigation is pending. Hence, she opposed the grant of anticipatory bail to the petitioner.

5. Considering the nature of the allegations and the fact that a huge quantity of gold weighing 141 grams has been swindled by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
