BY THE INSPECTOR OF POLICE DISTRICT CRIME BRANCH THIRUVARUR DISTRICT [ RESPONDENT ] Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., to direct the respondent not to harass the petitioner, complaint by one Muruganantham before the respondent police in C.S.R.No.45/DCB/TVR/2015 dated 11.03.2015 in the name of enquiry.
For Petitioner :Mr.O.S.Thilak For Respondent :Mr.C.Emalias, Additional Public Prosecutor
ORDER
This Criminal Original Petition is filed to direct the respondent not to harass the petitioner, based on the complaint by one Muruganantham before the respondent police in C.S.R.No.45 /DCB / TVR / 2015 dated 11.03.2015 in the name of enquiry.
2. This petition has come up today for admission. I have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and I have also perused the records carefully.
3. In my considered opinion, no blanket direction as prayed for by the petitioner could be given. If the petitioner is wanted either for enquiry or for interrogation, he can very well be summoned by the respondent police and while doing so, the petitioner shall not be harassed. At the same time, the petitioner should submit himself to the respondent for interrogation and enquiry. It is made clear that this order will not shield if the petitioner is involved in cognizable offence.
