This petition has been filed to direct the respondents to consider the representation dated 18.08.2016 & 25.08.2016 given by the petitioner seeking to provide him adequate police protection.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. The petitioner claims himself to be a social worker and states that, he is a ward member of the Machanur Panchayat, Vellore district. It is his submission that, he has been exposing the public causes and therefore, his life is under threat. Earlier the petitioner filed Crl.O.P.No.10625 of 2007, in which this Court by order dated 26.04.2016, directed as follows:- "The second respondent police is also directed to give protection to the life of the petitioner, if the situation warrants law and order problem. The criminal original petition is ordered accordingly".
4. The petitioner now seeks police protection, on the ground that, the earlier police protection has been discontinued. The petitioner has given representations on 18.08.2016 and 25.08.2016 to the respondent police, Home Secretary, Deputy General of Police, Inspector General of Police and Deputy Inspector General of Police seeking police protection.
5. In this regard, the respondent police had issued summons to the petitioner, asking him to appear for enquiry on the complaint given by him, but the petitioner has not responded to the enquiry. Be that as it may, it is for the respondent police to decide about the threat perception to a person and take action for providing police protection, if required. This Court cannot sit in
judgement over such decision of the executive authority and issue a direction as prayed for.
6.Under such circumstances, the petitioner is directed to co-operate with the police in enquiry and the police is directed to take action in accordance with law.
