ORDER

The petitioner apprehends arrest for the alleged offence under Sections 4(1)(A) and 4(1)(C) of Tamil Prohibition (Amendment) Act, 2024, in Crime No.366 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 26.12.2025, when the respondent police were on patrol, the petitioner was found in possession of 28 Old Chef Rum brandy bottles (each containing 180 ml) with intention to sell the same to the public; hence the case.

3. The learned counsel appearing for the petitioner submitted that he is an innocent person and has been falsely implicated in this case. He would submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are 32 previous cases pending against the petitioner and if anticipatory bail is granted, it will send a wrong signal to the society. Therefore, he opposed the petition.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the facts and circumstances of the case and also taking note of the fact that there are 32 previous cases pending against the petitioner and if anticipatory bail is granted, there is every likelihood that the petitioner would commit similar kind of offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the Criminal Original Petition is dismissed. 12-03-2026 MPA To 1.The Inspector of Police, Bagayam Police Station, Vellore.
