28.R.Hariharan : Respondents Prayer : Petition filed to condone the delay of 2417 days in re-presenting OSA SR No.61480 of 2017.

Appeal sought to be filed against the order dated 08.03.2017 in A.No.5635 of 2014 in C.S.No.51 of 2005.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Counsel for petitioner seeks leave to withdraw the petition. Counsel further states that the records do not indicate that the suit is pending in this Court.

2. Mr.Salautheen states that the suit has been returned, to be filed in the appropriate Court, in view of the pecuniary jurisdiction, and further states that he shall, within one week of the suit being lodged, address a

communication to the advocate for appellant.

3. Petition stands dismissed as withdrawn. Consequently, OSA (CAD) SR.No.61480 of 2017 is also dismissed. There will be no order as to costs.

4. All rights and contentions are kept open to be taken at the hearing of the suit.
