JUDGMENT

(Delivered by Dr. ANITA SUMANTH.,J) Having heard Mr.R.Pradeep, for the appellant and Mr.Kartik Subramanian, appearing for the first respondent, it becomes very clear that this appeal falls within a narrow compass. 2.

The appellant states that it has complied with the directions under paragraph 25 of the impugned order, and documents listed in the annexure to the application have been deposited with the Registrar General of this Court within the time stipulated. He is however aggrieved with the observations that figure between paragraphs 20 and 24 on the merits of the matter, since he states that, that would stand in the way of 2/4

an open trial and would plead that those observations should not be take into consideration in further proceedings.

Learned counsel for first respondent would accede to the request.

In light of the fact that the parties are consensus ad idem on the issue, it is made clear that trial in C.S.No.201 of 2024 shall proceed unfettered by the weight of the observations, in the impugned order between paragraphs 20 and 25.

This Original Side Appeal is closed in terms of this order. No costs.
