The petitioner, who was arrested and remanded to judicial custody on 18.12.2022 for the alleged offence under Sections 379 of I.P.C. in Crime No.111 of 2022 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 06.09.2022 when the defacto complainant was travelling from Vijayawada to Pondicherry in a train, she kept her gold ornaments weighing 72 grams along with cash of Rs.16,000/- and a wrist watch in her bag, at about 11.30 p.m. in a moving train, the petitioner said to have snatched her bag with the said ornaments. Hence, the complaint.

3. The learned counsel for the petitioner submitted that there is no specific overtact attributed against the petitioner and she is an innocent person and she has not at all committed any offence as alleged by the respondent police. He would submit that when she was travelling from

Bangarpet railway station to Chennai to visit her relatives, the respondent police alighted her from the train and foisted a false case against her. He would submit that she is no way connected with the occurrence and she will abide by any condition that may be imposed by this court. He would further submit that the investigation is almost completed and that the petitioner has been suffering incarceration from 17.12.2022. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that she is the sole accused and from her, 41 grams of gold was recovered and one previous case similar in nature is pending against her. He would submit that if she is released on bail, she would tamper the witnesses and hamper the investigation and the investigation is not yet completed. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and the submissions made by both counsel and also considering gravity of offence

committed by the petitioner, one previous case similar in nature pending against her and if she is released on bail, there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
