This Criminal Original Petition has been filed to recall the non bailable warrant issued by the learned III Fast Track Metropolitan Magistrate Court, Saidapet, Chennai, in CC.No.3881 of 2016.

2. The petitioner is arrayed as accused in CC.No.3881 of 2016, on the file of the learned III Fast Track Metropolitan Magistrate Court, Saidapet, Chennai, for the offences punishable under Section 138 of the Negotiable Instruments Act.

3. The petitioner was absent during the trial in CC.No.3881 of 2016, on the file of the learned III Fast Track Metropolitan Magistrate Court, Saidapet, Chennai. Therefore non bailable warrant came to be issued on 18.12.2020.

4. The learned counsel appearing for the petitioner undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.

5. Considering the undertaking given by the petitioner, the petitioner is directed to appear before the learned III Fast Track Metropolitan Magistrate Court, Saidapet, Chennai, within a period of two weeks from today and file a petition to recall the NBW issued against him. The concerned Magistrate is directed to consider the same on merits and pass orders on the same day. The Court below shall get a bond under Section 88 of Cr.P.C., from the petitioner.

learned III Fast Track Metropolitan Magistrate Court, Saidapet, Chennai to complete the proceedings in CC.No.3881 of 2016, within a period of three months from the date of receipt of copy of this order.
