1. The learned counsel for the applicant concedes that a part of the cause of action has arisen in Kolkatta.

1.1. It is also conceded by the learned counsel for the applicant that in the captioned matter, award has been passed in Kolkatta.

2. As per the terms of the agreement obtaining between the parties, in the captioned matter, there is an exclusive jurisdiction clause, which provides that, only the Courts in Kolkatta will have jurisdiction.

3. Having regard to the aforesaid, learned counsel for the applicant seeks to withdraw the captioned application with liberty to approach the concerned Court.

4. The application is dismissed as withdrawn with liberty, as prayed for.
